Brown v. McCain:

Decision refusing to dismiss Jackson Browne’s copyright infringement, Common Law Right of Publicity, Vicarious Copyright Infringement and Lanham Act claims against McCain and The Republican National Committee. The Court stated "Plaintiff needs to show a mere possibility of success on his claim" and that the defendant "has not shown that political expression’s broad First Amendment protection bars, as a matter of law, all actions based on allegedly improper use of a person’s identity in campaign-related materials."  (Posted by Tamera Bennett…)

InfoMedia Inc v Air-O-Matic Inc:

Complaint by InfoMedia, Inc., developer of iFart Mobile, against Air-O-Matic, Inc. in Colorado Federal court, seeking a ruling that the phrase “pull my finger” is a common, descriptive phrase not protected by Federal trademark law. (Posted by Kevin Houchin…)

In the matter of Cohmad Securities Corporation:

National Cable & Telecommunications Association v. Federal Communications Commission and United States of America:

Federal appeals court decision upholding telephone privacy regulations that require phone companies to obtain affirmative, opt-in consent from customers before they disclose personal information to outside corporations.
