This just in from the Electronic Frontier Foundation (EFF) - the amicus brief in support of defendant BlockShopper.com's motion to dismiss the lawsuit filed by Jones Day against the real estate news site. Jones Day has alleged that BlockShopper's use of the trademark "Jones Day" to refer to the firm in a headline and linking to the Jones Day website could lead to confusion over the sponsorship of the site.

The brief, filed by EFF and Public Citizen, joined by Public Knowledge and Citizen Media Law Project, urges the federal judge in Chicago to dismiss Jones Day's claims, on the ground that they are  aimed at quashing speech by an online news site.

According to the Amici:

If Jones Day’s trademark theory were correct, no news site or blog could use marks to identify markholders, or links to point to further information about the markholders, without risking a lawsuit.

As a legal professional, in what ways do you participate online?

This is my follow-up question to the list I published earlier this week: lawyers and legal professionals to follow on Twitter. Please share your answer below - post a comment.

As a community, we have much to learn from each other (the original point of my list!). Let's start with a look at how you are experimenting (and succeeding) online. Key word: experiment.

Twitter and Beyond: How Do You Connect the Dots?

I'm thrilled to see the blogosphere buzz around the Twitter list (including Carolyn Elefant's Twitter: A Downpour of Information But the Sun Always Shines, among many others).

My feelings about Twitter are probably clear to you. Here's what one of my favorite attorney Twitterers, @nikiblack, says in a comment at Kevin O'Keefe's LexBlog:

...it's an invaluable tool-for professional networking, for a sense of community, for getting a true sense of "virtual" colleagues' personalities, for personal branding and for personal expression.

Agreed. And at the intersection of the professional and the personal, Twitter not only allows you to influence, it also allows you to be influenced. This is one of its greatest strengths, I believe.

(I also agree wholeheartedly with @samglover, @stevematthews, @christinemartin and others who, in different ways, have pointed out that only following lawyers is probably a bad idea. Only blasting out marketing messages is also a bad idea. And only tweeting about the extraordinarily mundane details - not so good either. Mix it up.)

Many of the personalities represented in my list of lawyers who Twitter also actively participate in the open landscape. They are on LinkedIn and Facebook. Some of them podcast and conduct webinars. Some blog. Some share bookmarks and reading lists in a variety of excellent venues. More and more publish their legal documents on JD Supra.

(I'd be remiss if I didn't say this: if you are looking for attention online, post your legal documents to JD Supra.)

The trick: connect the dots. The open landscape is not a vacuum. Your role models should be those people who know how to use these tools in tandem with each other.

Participating online is not solely a marketing exercise, but it does borrow from many of the things that lead to good marketing: conversation, collaboration, networking, distribution, the influence of community. Always, it is varied mix of all of these, and more...

JD Supra contributor Brian Rowe has posted a new HOT DOC: the recent decision in J.K. Rowling v. RDR Books!

Here's Brian's summary of the decision:

The Harry Potter Lexicon was found infringing on Rowling's copyright and fair use was denied as a defense.

The Court engaged in a full four factor balancing test from section 107 of the copyright act. The court relies heavily on the harm to a potential market for Rowling own compendium and the Lexicon taking too much from Rowling works. This case criticizes paraphrasing and quoting in a commercial work that does not criticize the original and may set troubling precedence for futuretransformative works.

The fact that Rowling claims to want to publish her own competing companion book to the lexicon and donate the proceeds to charity receives mention from the court.

The court claims that “publication of the Lexicon would also result in harm to the charitable organization … More concretely, publication of the Lexicon would cause irreparable harm to the sales of Rowling’s companion books, all the elements of which are replicated in the Lexicon for a similar purpose. Readers would have no reason to purchase the companion books since the lexicon supersedes their value” (page 64)

Generally the case claims reference guides and companion books about literary works are a critically important part of literature, and that the right to publish them are generally unchallenged. As a general matter authors do not have the right to stop publication of reference guides and companion books about literary works.

This 68 page opinion is well worth reading. Fair use in the case of commercial works is a hotly disputed area of contention, this case is the latest in an ongoing battle to forge legal business models and add competition through transformative works.

File under: Friday fodder. For your reading pleasure, here are links to five recent articles and/or blog posts - each one, in some fashion, to do with Search. All worth a read as you develop and fine tune your online strategy.

• Web 2.0 Still a No-go - article in the September issue of ABA Journal to do with online adoption by legal professionals. ("Just the beginning.") Of note: "practically everyone" conducts legal research online. (2008 number: 96%. Five years ago: 79%.)
• SEO for Law Firms: Why Adwords is Not the Solution - in an informed, well-reasoned position piece, Stem Legal's Steve Matthews asks: "Are you building assets or just renting space?" (Among other excellent questions to do with using Adwords to market your service.)
• Search Engine Use - latest findings from the Pew Internet & Anerican Life Project (initially reported by Lexblog's Kevin O'Keefe.) Just under a half (49%) of Internet users use search in a typical day. (Up from roughly one-third in 2002.)
• "Google is the New Resume" - actual title of this post is The Socialization of Your Personal Brand, and in it PR leader Brian Solis frames his analysis around one key characteristic of online search: "Truth be told, any search engine, whether social or traditional, is the resume – it’s the Wikipedia entry for the rest of us."

File under: great timing. This morning, as I considered a quick post about "Influence" (linking to blogs or blog posts outside of the legal realm that nevertheless "influence my expertise"), Stem Legal's Steve Matthews tagged me to jump into the latest meme: 5 Blogs & 5 Blawgers.

The idea, if it isn't already clear to you: list five great non-legal blogs, then tag five blawgers to do the same.

Surprisingly willing to participate in the closest thing the blogosphere has to MLM, here's my list. Hope you enjoy it:

• Junta42 Blog - ground zero for everything you need to know about content marketing. Evangelist Joe Pulizzi has built a rich clearinghouse of CM information at Junta42, and his blog is just tip of the iceberg.
• Corante - "Corante blogs examine, through the eyes of leading observers, analysts, thinkers, and doers, critical themes and memes in technology, business, law, science, and culture." Excellent source for thought-provoking analysis of the current cultural landscape.
• Webware - perhaps too predictable a choice, but CNET's Webware ("Cool Web Apps for Everyone")  is a daily source of news for me. And it is published as a blog. And it deserves to be listed. Enough said.
• Copyblogger - tagline: "copywriting tips for online marketing success." Agreed. A reliable , consistently worthwhile source of "writing advice" for those interested in online marketing. Much of what I read here resonates with what I've learned over the years as a writer and editor.
• Cha Dao - the fun entry. To say that I am a tea geek is an understatement. It's all about Chinese tea in our household - loose leaf oolongs and aged pu-erhs. Cha Dao, a collaborative blog (in which I sometimes participate), is one of the handful of ways I stay informed and learn. Esoteric? Sure. But where else can yours truly hold forth on Tea Moons, Mesostics, and Circle Poems? 

That's the list - catch me tomorrow and it might look a little different.

Sexy title, but is it really possible to increase online visibility in one easy step?

Actually, yes, it is. Here's how: 

Repurpose. Share your daily written work online.

It's a common refrain around here. We were inspired to, ahem, repurpose it after reading a post at Allison Shields' excellent Legal Ease Blog - a blog that comes with the tagline: "Helping lawyers and law firm managers create more productive, profitable and enjoyable practices and prevent 'Lawyer Meltdown'."

Allison regularly publishes into the mix a Do Something! feature in which she offers practical advice to lawyers and firms centered around a single action. (For examples, see the entire category of posts, linked here.)

The recent entry that inspired us? Do Something! Repurpose:

...I'm willing to bet that you can find even more to repurpose (and save yourself time, effort and money in the process) that you hadn't thought about.

Marketing is a great place to repurpose, particularly with all of the new technology that's in place for marketing. Don't think you have time to blog, do seminars, write articles, network and follow up with individual clients by sending them information relevant to their business? If you're doing one of those things, chances are that you can repurpose what you're doing into at least two more, with minimal effort. In fact, you can repurpose your legal work into your marketing efforts as well. 

Allison's two examples (research for a specific case; conducting a seminar) hinge upon leveraging expertise to create marketing materials for a wider audience. (Turn your research into a case study; turn your seminar into an article; etc.) And this is exactly the point.

To repurpose is to leverage your strengths. 

You have expertise and authority in your field of practice. Your daily written work (articles, alerts, newsletters, legal documents, filings) is, again, the first example of this. Repurpose it - leverage it - publish it online. The alternative: use it once, then let it collect dust.

Publishing work that is then indexed by the search engines (our own, as well as Google, Yahoo!, Ask and, most recently, Lexis Search Advantage) - that's the first step towards increasing online visibility.

There are many other steps - proactive steps that are, themselves, additional types of online repurposing. They also happen to be some of the best reasons why today's online landscape is so incredibly exciting.
